BRAINIFY
A note from Murray:
Hey everyone. This legal document spells out what we are going to do
with the information you give us. Essentially, we are going to do our
very best to keep your private information private, and we won’t sell,
rent or use your names or e-mail addresses for purposes that are not
what you would expect when you joined. So you are safe from getting
a bunch of extra spam because you gave us your e-mail address. Having
said that, you need to be aware that this is a public site and people
will see what you do and what others do – comments, ratings, etc –
it’s all public info. Those are the very basics, but you’ll need

PRIVACY POLICY
The following Privacy Policy outlines your rights and obligations respecting your privacy when using Brainify’s website at www.brainify.com , as well as Brainify’s browser plug-in and Brainify’s link which can be placed on your external content pages (collectively, the website, the plug-in and the link are the “Site”). You can and should also review: (a) Brainify’s Terms of Use, which outline the general terms of use respect your use of the Site; (b) Brainify’s Reputation and Proceeds Distribution Policy, which describes the terms and conditions respecting Brainify’s intention of sharing a portion of the proceeds of a sale of Brainify with the Brainify community; and (c) Brainify’s Content Disclaimer, which describes the terms and conditions respecting Content (defined below) made available on or through the Site.
Brainify was founded for the purpose of enabling people to find and share text, comments, categorizations, taggings, rankings, messages, information, data, graphics, news or academic articles, papers, theses or other works, photographs, images, illustrations, software, audio clips and video clips (collectively, "Content") by enabling them to link to, rate, rank and comment on what they find interesting, helpful or authoritative. Brainify knows that you care about how your personal information is used and shared, and Brainify takes your privacy very seriously. Please read the following to learn more about Brainify’s policies and procedures respecting your privacy and your personal information. By visiting the Site, you are accepting the practices outlined in this Privacy Policy.
This Privacy Policy describes Brainify's treatment of information that Brainify gathers when you are on the Site and when you use Brainify’s services. This Privacy Policy does not apply to the practices of third parties that Brainify does not own or control, or to individuals that Brainify does not employ, contract with or manage.
1. INFORMATION COLLECTED BY BRAINIFY
Brainify only collects information from Members that is relevant to the use of the Site or that is required for Brainify to share the proceeds of a sale of Brainify with its Members (see Brainify’s Reputation and Proceeds Distribution Policy for further details). Brainify does not process this collected information in a way that is incompatible with these purposes. Brainify collects the following types of information from Brainify Members:
In order for you to use many of the features of the Site and Brainify’s services, such as submitting Content to the Site and receiving reputation points, you must create a Member Account. In creating a Member Account, Brainify requires you to provide certain personal information (including your full name, city, province or state, country and e-mail address). Brainify requires this personal information so that it is able to identify and contact Members in the event of a sale of Brainify so that Members can receive a portion of the proceeds of such sale. See the Reputation and Proceeds Distribution Policy for further details.
In addition to the information that you are required to provide, Brainify allows you to include additional information as part of your Member Account, such as a bio, favorite URLs, academic preferences and activities, etc. You may also choose to include photos of yourself as part of your Member Account. You should be aware that other than certain identifying personal information that you provide, such as your name, address and e-mail address, all information that you provide in creating or amending your Member Account will be publicly available.
Brainify receives and stores certain types of information whenever you interact with the Site or other Members. For example, Brainify and its authorized agents automatically receive and record certain "traffic data" on their server logs from your browser including your IP address, Brainify cookie information, and the page(s) you requested. Brainify uses this traffic data to help diagnose problems with its servers, analyze trends and administer the Site.
In addition, Brainify will collect
and display in various places on the Site other information respecting
individual Members and their interactions with other Members on the
Site. This other information will include but not be limited to
the number of times that an individual Member’s Account page has been
viewed, ratings and rankings of individual Members, comments made by
and about individual Members and the number of reputation points held
by Members.
2. E-MAIL
COMMUNICATIONS
Brainify is very concerned about your privacy and will never provide your email address to a third party without your explicit permission, as detailed in the "Sharing Your Information" section below. Brainify may send out e-mails with Brainify-related news, products, offers, surveys or promotions. You may also receive notification e-mails from Brainify which inform you of actions (e.g. friend requests) that have been performed on the Site. If you do not want to receive e-mail from Brainify, please select the appropriate choice in your Member Account and/or follow the instructions contained in the unwanted e-mail message. However, please note that in all cases you will continue to receive all system e-mails (e.g. those regarding forgotten Member passwords) and legal notices (e.g. updates to Brainify policies).
3. COOKIES
Cookies are alphanumeric identifiers
that Brainify transfers to your computer's hard drive through your Web
browser to enable Brainify’s systems to recognize your browser and
tell Brainify how and when pages on the Site are visited and by how
many people. The "help" portion of the toolbar on the majority
of browsers will direct you on how to prevent your browser from accepting
new cookies, how to command the browser to tell you when you receive
a new cookie, or how to fully disable cookies. Brainify recommends that
you leave the cookies activated because cookies are required to enable
you to use all of the Site’s features.
4. SHARING YOUR INFORMATION
Because Brainify enables people to discover and share Content with one another, information about Brainify Members and their activities is an integral part of the Site and the services provided by Brainify. Brainify will never rent nor sell any information that you provide to it and will share your personal information only as follows:
(a) Brainify’s officers, directors, employees, consultants and/or contractors may have access to Member information if necessary in the normal course of Brainify’s business or to perform a specific task. All of Brainify’s officers, directors, employees, consultants and/or contractors will be required to enter into agreements with Brainify prohibiting disclosure or inappropriate use of this information.
(b) In some cases, Brainify may choose to buy or sell assets. In these types of transactions, User and Member information is typically one of the business assets that will be transferred. However, Brainify will not separately sell or rent any information that you provide to it, and such information will only be transferred in connection with a sale of all or substantially all of Brainify’s assets.
(c) Brainify may release information if it believes, acting reasonably and in good faith, that release is necessary to comply with a law, to enforce or apply its Terms of Use and other policies, or to protect the rights, property, or safety of Brainify, its directors, officers, employees, consultants and contractors, its Users or others.
(d) Certain information collected by Brainify during the creation of and amendments to your Member Account may be displayed to other Brainify Members in your Member Account. Your full name and address will not be publicly available through your Member Account and will only be made available to other persons through actions taken by you (for example, your name and/or e-mail address may be disclosed to a person that you invite to Brainify).
(e) The e-mail address that you submit upon creating your Member Account may be searchable by other Brainify Members. This is primarily so that other Members who know you through your e-mail address can find you through the Site. However, unless you explicitly agree, Brainify will not provide your e-mail address to other Users in the general operation of the Site.
(f) Brainify allows other Users to browse Content that you have submitted, linked to, ranked or commented on. This information is made available via your Member Account or within the Content on which you performed the action. Brainify may choose to post this data on other Site features.
(g) Other Members, even if they are not your “friends” on the Site, will be able to see who your friends are and in some cases certain of your interactions with those friends.
(h) Brainify will allow third parties access to all Content and data that are already publicly available through the Site. Brainify will keep private any passwords and other settings.
(i) Brainify may allow for the RSS syndication of any or all Content.
(j) Except as noted above, Brainify will seek your consent before sharing your information with third parties or using your information for a purpose incompatible with the purpose(s) for which it was originally collected.
5. KEEPING INFORMATION SECURE
Your Member Account information is protected by your password for your privacy and security. You should protect against unauthorized access to your password and to your computer by logging off of the Site once you have finished using a shared computer.
Many aspects of the Site and your interactions with the Brainify community depend on the reputation and respect that is built up among Members through a history of valued contributions of Content. In addition, any participation by a Member in the proceeds of the sale of Brainify in accordance with Brainify’s Reputation and Proceeds Distribution Policy will be based on the reputation points held by that Member. Member passwords are the best safeguard of the integrity of a Member's history on the Site, which will be represented by reputation points that have been assigned to a Member. All Members are encouraged to select strong passwords and to never share them. Brainify will never knowingly expose or release the password of another Member to the public or any third party. Brainify will not be responsible for any damages or losses incurred by a Member as a result of that Member’s password or Account being stolen or hacked by a third party.
Only Brainify’s officers, directors, employees, consultants and contractors who need information respecting Members in the normal course of Brainify’s business or to perform a specific task are granted access to such information. All of Brainify’s personnel are kept up to date on Brainify’s privacy and security practices.
6. CONTROLLING DISPLAY AND USE OF YOUR INFORMATION
By visiting your Member Account, you can correct, amend, add or delete (except for information which is required to be provided to create a Member Account) information provided in such Member Account. When you update information, however, Brainify may maintain a copy of the unrevised information in its records.
You may request deletion of your Brainify Member Account by e-mailing Brainify at support@Brainify.com, although Brainify may retain a copy of your deleted Member Account in its records.
If you do not wish to receive e-mail or other messages from Brainify or other Brainify Members, please visit the e-mail preferences section of your Member Account and/or follow the instructions contained in the unwanted e-mail message. However, please note that you will continue to receive all system e-mails (e.g. those regarding forgotten user passwords) and legal notices (e.g. updates to Brainify’s policies).
As explained earlier, the "help" portion of the toolbar on the majority of browsers will direct you on how to prevent your browser from accepting new cookies, how to command the browser to tell you when you receive a new cookie, or how to fully disable cookies. Please note, however, that if your browser does not accept cookies, you will not be able to take advantage of all of the features of the Site.
7. RESTRICTIONS
You must be 13 years and older to register to use the Site. As a result, Brainify does not specifically collect information about children. If Brainify learns that it has collected information from a child under the age of 13, subject to applicable law it will delete that information as quickly as possible. Brainify recommends that minors between the ages of 13 and 18 ask and receive their parents' or guardians’ permission before using the Site or sending information about themselves or anyone else over the Internet.
8. MODIFICATIONS TO THIS PRIVACY POLICY
Brainify reserves the right, at its sole discretion, to modify or replace this Privacy Policy at any time. If the alterations constitute a material change to the Privacy Policy, Brainify will notify you by posting an announcement on the Site. What constitutes a "material change" will be determined in Brainify's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Your use of the Site and the Services following such notification constitutes your acceptance of the terms and conditions of the Privacy Policy as modified.
This Privacy Policy is effective as of October 1, 2008.
