This one essentially says that you guys are, for the most part, in control of what is on our website – not us. The following Content Disclaimer outlines the terms and conditions respecting the materials displayed, transmitted or performed on the Site or through the Services offered by Brainify, (including, but not limited to text, comments, categorizations, taggings, rankings, messages, information, data, graphics, news or academic articles, papers, theses or other works, photographs, images, illustrations, software, audio clips and video clips, also known as the "Content"). You can and should also review: (a) Brainify’s Terms of Use, which outline the general terms of use with respect your use of the Site; (b) Brainify’s Privacy Policy, which outlines Brainify’s obligations and practices towards handling any personal information that you may provide to Brainify; and (c) Brainify’s Reputation and Proceeds Distribution Policy, which describes the terms and conditions respecting Brainify’s intention of sharing a portion of the proceeds of a sale of Brainify with the Brainify Community. Capitalized terms used in but not defined in this Policy shall have the meaning attributed to such terms in Brainify’s Terms of Use.

1. NO GUARANTEE OF VALIDITY

Brainify was founded for the purpose of enabling people to find and share Content by enabling them to link to, rate, rank and comment on what they find interesting, helpful or authoritative. The purpose and structure of Brainify enables any Member to post Content on the Site and to comment on, rank or rate Content. It is expected that the Brainify Community will determine the Content which is the most authoritative, accurate or helpful in any given subject by way of Community rankings. However, you should be aware that none of the Content on the Site has necessarily been reviewed by people with the expertise required to provide you with complete, accurate or reliable information with respect to the subject matter of any of the Content. Users of the Site should take all steps necessary to ascertain that any Content is correct and has been verified by independent sources.

2. NO EXPRESS OF IMPLIED WARRANTY

Brainify cannot and does not guarantee the validity or accuracy of any of the Content found on the Site, and all such Content is provided without any express or implied warranty from Brainify. Any Content you may find on the Site may be inaccurate, misleading or libelous. None of Brainify or any of its directors, officers, employees, contractors or consultants are in any way responsible for any Content found on the Site.

3. NO GUARANTEE OF SAFETY OR LEGALITY

Any Content you may find on the Site may concern dangerous, unethical or illegal activities, practices or behaviour. There is no guarantee that the authors of the Content are qualified to provide readers with information sufficient to ensure that such activities, practices or behaviour are undertaken with adequate safety precautions or steps that can be taken to prevent injury, bodily damage, or other damages to people, property or reputation, or are undertaken in adherence with applicable laws or regulations or prevailing ethical standards.

5. OBJECTIONABLE OR DANGEROUS CONTENT

Some of the Content available on or through the Site may contain words, phrases or topics which are objectionable to or censored by educational, governmental, corporate, parental or other parties, or may be otherwise dangerous to certain Users. For example:

1. Content may include or discuss words or language considered profane, vulgar or offensive by some Users.
2. Content may include or discuss images which may be considered objectionable or offensive by some Users. For example, some Content may contain graphical depictions of violence or depictions of human anatomy.
3. Content may contain names, images, artworks or descriptions of events to which some cultures restrict access.
4. Content may include or contain frank discussion of controversial topics. Some Content may include or contain subjects that have criminal applications in some jurisdictions.
5. Content may contain triggers for people with post-traumatic stress disorder or similar conditions.
6. Content may contain images and/or videos which may trigger epileptic seizures or similar conditions.

Brainify does not intend to actively review the Content that is available on or through the Site. However, if it comes to Brainify’s attention that any Content breaches the laws of the Province of British Columbia or the federal laws of Canada applicable therein then it is Brainify’s intention to remove any such Content from the Site.

6. MODIFICATIONS TO THIS CONTENT DISCLAIMER

Brainify reserves the right, at its sole discretion, to modify or replace this Content Disclaimer at any time. If the alterations constitute a material change to the Content Disclaimer, Brainify will notify you by posting an announcement on the Site. What constitutes a "material change" will be determined in Brainify's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. Your use of the Site and the Services following such notification constitutes your acceptance of the terms and conditions of the Content Disclaimer as modified.

7. EFFECTIVE DATE

This Content Disclaimer is effective as of October 1, 2008.
